  6. SHAREWARE LICENSE

  8. The shareware version of Internet Graphics Finder is 
  9. provided at no charge to the user for a 30-day 
  10. evaluation.  Feel free to share it with others, but 
  11. do not give it away altered or as part of another 
  12. system.  
  13.  
  14. If you find this program useful and continue to use 
  15. it after 30 days, you must make a registration 
  16. payment to SkibbySoft or an authorized vender for 
  17. the fee specified on the registration form found 
  18. in the program's help file.  The fee will license 
  19. one copy for use on any one computer at any one 
  20. time. The registration fee will allow the licensee 
  21. to turn on any options that are disabled on the 
  22. shareware version.

  24. Anyone distributing the shareware version of 
  25. this program for any kind of remuneration must 
  26. first contact SkibbySoft at the address contained 
  27. in the help file for authorization.

  30. REGISTERED LICENSE

  32. SkibbySoft licenses this single user software, 
  33. Internet Graphics Finder, to you, the first user, 
  34. for use on any computer for which it was designed.  
  35. This means we allow you to use the software on 
  36. a single machine at a single site at a single time.

  38. SkibbySoft additionally authorizes you to use a 
  39. copy of Graphics Discovery on a secondary home 
  40. or laptop computer, as long as this copy is never 
  41. in use at the same time as the software copy which
  42. resides on your primary computer.  You must pay 
  43. for additional copies of the software if more 
  44. than one person will be using it at the same time.  
  45. You may not use it on a network unless all persons 
  46. who will access the software have an individual 
  47. license.

  52. GOVERNING LAW

  54. This agreement shall be governed by the laws of 
  55. the State of Washington.

  57. DISCLAIMER OF WARRANTY

  59. SkibbySoft warrants that for a period of ninety 
  60. days from the date of delivery of the licensed 
  61. program, the program, if unmodified by the Licensee, 
  62. will perform in substantial conformity with 
  63. the user documentation.  SkibbySoft does not 
  64. warrant that the licensed program is free from 
  65. coding errors.  Any modifications to the licensed 
  66. program shall thereafter be licensed AS IS.

  68. The above warranty does not apply to the extent 
  69. that any failure of the licensed program to 
  70. perform as warranted is caused by the licensed 
  71. program being (1) not used in accordance 
  72. with the user documentation, or (2) modified 
  73. by any person other than authorized SkibbySoft 
  74. personnel.

  76. LICENSOR MAKES AND LICENSEE RECEIVES NO OTHER 
  77. WARRANTY OF ANY KIND, EXPRESSED OR IMPLIED, 
  78. INCLUDING WITHOUT LIMITATION, ANY WARRANTIES 
  79. OF MERCHANTABILITY AND/OR FITNESS FOR A 
  80. PARTICULAR PURPOSE.

  82. The total liability of SkibbySoft for any claim 
  83. or damage arising out of the use of the licensed 
  84. program or otherwise related to this license 
  85. shall be limited to direct damages which shall 
  86. not exceed the license fee(s) which have been 
  87. paid by Licensee to SkibbySoft for the specific 
  88. client project which is the subject of such 
  89. claim or damage.

  91. IN NO EVENT SHALL LICENSOR BE LIABLE TO 
  92. LICENSEE FOR ADDITIONAL DAMAGES, INCLUDING 
  93. ANY LOST PROFITS, LOST SAVINGS OR OTHER 
  94. NCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING 
  95. OUT OF THE USE OF OR INABILITY TO USE THE 
  96. LICENSED PROGRAM, EVEN IF LICENSOR HAS BEEN 
  97. ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  99. IN NO EVENT SHALL LICENSOR BE RESPONSIBLE 
  100. OR LIABLE TO LICENSEE FOR OBJECTIONABLE 
  101. MATERIAL OBTAINED THROUGH THE USE OF THE 
  102. LICENSED PROGRAM. THE LICENSEE MUST ADHERE 
  103. TO ALL COPYWRITE LAWS AND IMAGE USE RULES 
  104. SPECIFIC TO THE IMAGE SOURCE.
